General 

• The ‘Hirer’ means the person signing the booking form for ‘Hire of equipment’. Provisional bookings for parties booked more than 4 weeks in advance will be held for 4 days, parties booked within 4 weeks of the party date will be held for 48 hours. Party dates not confirmed within these times will be re-released.

• Payment of a deposit is acceptance of these terms and conditions and is considered a binding contract.

​

• Our hire prices include complimentary delivery within 10 miles from our base in Epsom, Surrey.

​

• Out of area bookings can be arranged at an additional delivery cost of 0.90p a mile, there and back on each journey. Some addresses in London will incur an additional delivery charge due to the congestion charge.

​

• The final numbers and choices must be confirmed at least 14 days prior to the date of the booking. Any booking reductions after this time will still be charged for at the previous rate, with no refunds due.

​

• The Hirer is responsible for providing The Cosy Corner Company staff with all relevant medical/dietary information for all the children attending the party. The Cosy Corner Company take no responsibility for allergies (including skin, food, materials etc) where we are not advised in advance of the condition. We are likewise not responsible at any point, for the welfare of the children at the parties, which remains the full responsibility of the hirer.

• The Hirer is responsible for ensuring the accuracy of the information given to The Cosy Corner Company and to pass over such information in sufficient time for The Cosy Corner Company to perform the contract safely and without risk, within 14 days of the event occurring, to avoid last minute disappointment.

​

• The Cosy Corner Company reserves the right to make any changes to the services as is deemed necessary by The Cosy Corner Company without notice to the Hirer. If the required service is less than originally requested the requisite refunds will be made to the Hirer.

​

• The Hirer is responsible/ liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any The Cosy Corner Company equipment.

​

• It is the Hirers responsibility to ensure that the children are supervised at all times. The Cosy Corner Company will charge the hirer for the costs of any damage to any property caused by your breach of this clause.

​

• It is the Hirers responsibilities to ensure the children comply with all reasonable instructions from The Cosy Corner Company employees to ensure the safety of the attendees and other persons present. The Cosy Corner Company may suspend the event if you are in breach of this clause.

​

• The Cosy Corner Company will accept no liability or responsibility to the Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of Hirer and their guests, or any consequential loss in these regards.

​

• The Cosy Corner Company shall use all reasonable endeavors to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and diligence.

​

• The Cosy Corner Company shall process all data in accordance with GDPR Act 2018.

​

• Some produce used may contain traces of nuts or may have been made in a factory that handles nuts. Please carefully check all ingredients before use/application.

​

• It is not the intention of The Cosy Corner Company to violate any copyright laws and all themes are only inspired by popular trends.

 

​

 

Company Responsibilities 

​

• The Cosy Corner Company will deliver, erect and furnish your bell tent, Teepees or Wigwam as per the agreed booking arrangements on the date specified and will return to dismantle and remove on the agreed end day of hire period. 

​

• The Cosy Corner Company accepts no responsibility or liability for damage or theft to any property left in our tents for the duration of the hire period. 

​

• The Cosy Corner Company accept no responsibility or liability for damage or injury to any member of your party may occur during the hire period. 

 

 

 

Hirer Responsibilities 

​

1. The Hirer is responsible for ensuring adequate space is available for the equipment to be erected. Dimensions required are outlined as follows: 

• 4 metre bell tent: 7 metre X 7 metre flat grass area. 

• Teepees: 1.9 metre X 1 metre

• Wigwam: 2.18 meters X 2 meter

 

• The Cosy Corner Company will not refund any monies paid in the event that adequate space is not available for set up. 

​

• We regret that our bell tents are not suitable for animals of any kind. 

​

• All The Cosy Corner Company bookings are strictly NON-SMOKING. 

​

• All rubbish, recycling and personal property must be removed from our tents prior to collection. The Cosy Corner Company reserves the right to levy a charge for the removal of any rubbish or waste left in the tent. This levy will be charged from the damage deposit.

 

 

Payment 

​

• A 25% non-refundable deposit is payable on booking to secure your date. Party date will be held for 48 hours. Party dates not confirmed within these times will be re-released. We require £50 which will act as a damage deposit. This will be refunded after inspection usually within 24 hours.

​

• The balance of hire is due 2 weeks prior to your booking, if you book your event within 2 weeks the full balance is due at time of booking. We require £50 which will act as a damage deposit. This will be refunded after inspection usually within 24 hours.

​

Cancellation (by the Hirer)

 

In the unfortunate event the party is cancelled the following refund policy will be applied:

 

• Cancellation of a booking up to 14 days prior to the party will forfeit the deposit paid.

​

• Cancellation of a booking between and including 13 and 7 days prior to the party will be refunded 25% of the additional monies paid.

​

• Cancellation of a booking after the dates specified will unfortunately forfeit all monies paid.

​

• The Cosy Corner Company will always endeavor to rebook a cancelled party at a later date for a further fee of £70.00 in addition to the full party cost previously paid.

 

Cancellation (by The Cosy Corner Company)

 

• The Cosy Corner Company reserves the right to cancel the booking at any time for any reason (The Cosy Corner Company will try to give as much notice as possible).

​

• Upon any such cancellation The Cosy Corner Company will refund to the Hirer any monies paid to The Cosy Corner Company in respect of the booking, but The Cosy Corner Company will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.

​

• The Cosy Corner Company reserves the right to terminate the booking without notice if there is a breach of these conditions.

 

​

 

Supervision

 

• The Hirer is responsible for the care and safety of all the children and should ensure that all parent/guardians are aware that The Cosy Corner Company are not responsible for the care and safety of the children.

​

• The Hirer is responsible for providing The Cosy Corner Company staff with all relevant medical/dietary information for all the children attending the party. The Cosy Corner Company take no responsibility for allergies (including skin, food, materials etc) where we are not advised in advance of the condition. We are likewise not responsible at any point, for the welfare of the children at the parties, which remains the full responsibility of the hirer.

​

• The Hirer will be required to take responsibility for all children that have been left by their parent/guardian. We would recommend that the Hirer of the party take contact telephone numbers of the children attending if their parent/guardian is not staying at the same time as clarifying any medical/allergic conditions at least 14 days in advance of the event.

Health and Safety 

​

• The Cosy Corner Company operates a STRICT NO SMOKING POLICY inside our bell tents. 

​

• Candles with flames are not permitted inside our bell tents. Fairy lights and lanterns will be provided for you. 

​

• For your protection and safety cooking is not permitted inside our bell tents. 

​

• Fire pits and BBQ’s should be a safe distance from our bell tents and should not be left unattended. 

 

​

 

Liability

​

• Nothing in these terms shall limit or exclude the liability of The Cosy Corner Company, which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by The Cosy Corner Company negligence or fraudulent misrepresentation.

​

• Subject to the above The Cosy Corner Company shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of the contract.

​

• Subject to the above clauses The Cosy Corner Company aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer.

​

• This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England.

​

• No information included in this booking form will be disclosed to any third party.

​

• It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions.

 

 

The Cosy Corner Company have suitable public liability insurance and take the upmost care to ensure the safety of all party guests at all times.

• We use high quality products and follow strict hygiene routines.

 

• Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter.

 

• All persons using The Cosy Corner Company equipment do so at their own risk and it is the party hirer who is responsible / liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use.

 

• This information is given for the safety of all people attending a party hosted by The Cosy Corner Company and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited.

 

Additional Charges 

• If any of our items for hire, including tents, furniture, fittings or decorations are damaged or missing you will incur additional charges. This payment will be taken from your damage deposit.

​

• We have a strict NON-SMOKING policy, should there be any indication of smoking inside our bell tents the booker will incur a £500 smoking fine.

Legal Details

​

• Force Majeure (unforeseeable circumstances preventing someone from fulfilling a contract) The Cosy Corner Company cannot accept any responsibility or liability for losses or other costs incurred as a result of: acts of God including fire, flood, storm or natural disasters, war, sabotage or acts of terrorism, government sanctions, labour disputes including strikes, lockouts, boycotts or other Industrial action, failure in the transportation of equipment or in the provision of services.

​

• Governing Law & Jurisdiction – This agreement and disputed or claims arising out of or in connection with it or its subject matter or formation (including noncontractual disputes or claims) are governed by and construed in accordance with the laws of England.

​

• The parties irrevocably agree that the Courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including noncontractual disputes or claims).

 

 

What we will do with your Data

This privacy notice clarifies the legal basis upon which your personal data and sensitive personal data will be obtained, processed and retained, it is provided in accordance with the General Data Protection Regulation (GDPR).

The data we obtain from you during the course of contract will be used solely for the purposes of providing you with our services, the data will only be used and processed by representatives of The Cosy Corner Company.

We will retain any personal data obtained for the duration of your contract for services on the Company’s secure computer database, email servers, and specialist software.

Limited data will be retained for a period of time to satisfy our legal or regulatory purposes.

Your right to object:

Under the GDPR you have the right to object to us processing personal data based on grounds relating to your particular situation.  If you object to us processing your personal data either relating to a specific set of circumstances or in general, we will stop doing so, but if by doing so we are unable to fulfil our Contract for Services, it may be necessary to terminate your booking with the Company.
